The actors are
splitting after two years of marriage. They have a son together, Maceo, aged
two.
In their joint
statement the couple said, 'It is with a heavy heart that we have come to the
decision to divorce. We move forward with love and respect for one another and
the shared focus for what is best for our son.'
It was added, 'We
wish each other nothing but happiness in life, and we hope that you respect
our, and most importantly our children's privacy, as we go through this
difficult period.'
Halle and Olivier - both 49 - were last seen together on October
17 while at a Halloween event in Sherman Oaks with her daughter Nahla, aged
seven, from her relationship with model Gabriel Aubry.
The two - who met
in 2010 on the set of their drama Dark Tide, which wasn't released until 2012 -
seemed to be in good spirits as they strolled through a parking lot side by
side. But on Monday the X-Men: The Last Stand beauty looked glum as she headed
out on a shopping trip alone.
According to TMZ Berry made the
filing and it was added that the two have a prenup. According to Celebrity Net
Worth she has a fortune of $80m.
The marriage
unraveled in the past week after they hit a 'breaking point,' the site
reported.
They had been
fighting over his January incident at LAX, where Olivier hit an airport
employee with a car seat, pushing him to the ground. He was sued in mid October
for the attack.
This 'exacerbated
their conflicts,' it was reported.
'They have a
personality difference,' it was also claimed by the site. 'They're just very,
very different people. He's a very macho guy, and things just didn't
jive.'
Sources also have
told TMZ that Halle 'is not asking for joint or primary custody, but rather
what is in the best interests of the child.'
Before Olivier
started a romance with Halle, he spent most of his time in his native France
and the two were hoping to move there, but because of her custody agreement
with Nahla, she has had to stay in the US.
A source however hinted that there
were no issues between the two. 'The relationship had run its course,' said a
friend. 'They are keeping it amicable now.'
The insider also
said that Halle - who told InStyle in 2007 'I will never, never get married
again' - was 'okay.'
For her first
anniversary the two went to Hawaii.
But in September,
Halle didn't seem to remember her wedding anniversary with Olivier when she
talked to E! News.
This will be
Berry's third divorce and Martinez's first.
The Catwoman star
was married to baseball player David Justice in the early 1990s and singer Eric
Benét in the early 2000s.
Olivier
dated Juliette Binoche from 1994 to 1997 then Mira Sorvino from 1999 to
2002.
From 2003 to 2007
he was with singer Kylie Minogue then he briefly dated Elsa Pataky.
